Terms of Service
In effect since October 17, 2026
1. Who provides the service
Avenza is a trade name. The service is provided by Ana Silvia Juarez Gutiérrez, an individual (persona física) with address at Sendero Edam Oriente 5, Fraccionamiento La Esmeralda, San Miguel de Allende, Guanajuato, México, C.P. 37893.
Contact address for anything related to the service: [email protected]. There is no other support channel.
2. What Avenza is
Avenza connects a business’s WhatsApp account to an artificial intelligence assistant that replies to its customers using the information the business itself has loaded. When the assistant cannot resolve a conversation, it flags it so that a person from the business can take over from the inbox.
What the service does not do
This list is not a generic disclaimer. It is the contracted scope.
- It does not perform actions. It does not book, it does not schedule, it does not charge, it does not create orders and it does not modify the business’s systems. It only writes messages.
- It only works with WhatsApp. Other channels appear in the app as planned; none of them is connected.
- It does not learn from your website or documents. The business knowledge is typed by hand into the app, and the assistant answers solely from it.
- It is not a CRM and it does not provide sales analytics.
The assistant can be wrong
Replies are generated automatically by a language model. They can be incorrect, incomplete or unsuitable for the case at hand. The business is responsible for the information it loads and for what its assistant replies to its customers, and it can switch the assistant off or take over any conversation at any time.
3. Who may use Avenza
Avenza is a service for businesses. Creating an account requires being at least 18 years old and having authority to bind the business being registered.
Account details must be accurate. Whoever creates the account is responsible for their credentials and for the activity of the people they invite to the business under any of the available roles.
4. Plans and limits
Assistant usage is measured in AI conversations per month. The plans are these, in US dollars:
| Plan | Price | Includes |
|---|---|---|
| Free | USD 0 | 1 seat · 30 AI conversations per month |
| Growth | USD 22 per month | 800 AI conversations per month · 14-day trial |
| Pro | USD 89 per month | 5,000 AI conversations per month · 14-day trial |
The free trial
Growth and Pro both include a 14-day trial, and starting it requires registering a payment method, such as a card. It is one trial per business: you can switch between Growth and Pro while it runs, but switching plans neither extends it nor grants a new one. When it ends, the subscription for the plan being trialled is charged, unless it is cancelled beforehand.
Paid plans cannot be purchased today, and so the trial cannot be started either. There is no payment gateway in the service and no way to subscribe to Growth or Pro. Prices are published so that they are known in advance, not because they are available. When they become available, these terms will be updated before anything is charged.
In the meantime, Avenza does not collect payment data.
5. Your WhatsApp account and Meta’s rules
Using Avenza requires connecting a WhatsApp Business account owned by the business. The business remains its holder and undertakes to comply with the Meta policies that apply to it.
Avenza sends and receives messages through Meta’s API. A change to that API, a suspension of the business’s account or a withdrawal of permissions by Meta can interrupt the service without Avenza being able to prevent it.
When the channel is disconnected, the stored access credentials stop being used. They are deleted from the encrypted store when the business is deleted, as described in section 9.
6. Your customers’ data
The end customers who write over WhatsApp have never had a relationship with Avenza: their data arrives through Meta because they wrote to the business. Hence this division of roles:
- The business is the controller (responsable) of its own customers’ personal data.
- Avenza is the processor (encargado) and processes that data solely on behalf of and under the instructions of the business, in order to provide it with the service.
With respect to that data, Avenza undertakes to:
- process it only to provide the service described in section 2;
- keep it confidential, including after the relationship ends;
- not use it for its own purposes: there is no advertising, no product analytics and no commercial profiling;
- delete it when the business deletes its account on the terms of section 9.
In turn, the business undertakes to maintain its own privacy notice, to inform its customers about the processing and to handle the rights requests they address to it. End customers exercise their rights before the business, not before Avenza.
Sensitive data
If the business processes sensitive personal data about its customers — health data, for example — it is the business, as controller, that must obtain the consent the law requires, in the form the law requires.
Article 8 of the Mexican Federal Law on Protection of Personal Data Held by Private Parties requires, for such data, express consent given in writing by the data subject, through their handwritten signature, electronic signature or any authentication mechanism established for the purpose. The same article adds that databases containing sensitive data may not be created without justifying their creation for legitimate, specific purposes consistent with the business’s activity.
Avenza does not obtain that consent and cannot obtain it on the business’s behalf. There is no mechanism in the service to do so. A WhatsApp message is not express written consent within the meaning of that article.
7. Availability
Avenza is provided as is and as available. No service level is guaranteed, nor any assistant response time, nor that the service will be free of errors or interruptions.
The service depends on third-party providers — the infrastructure, the artificial intelligence model and Meta’s API — and unavailability of any of them interrupts Avenza.
8. Acceptable use
When using Avenza, the business undertakes not to:
- send unsolicited communications or use the service for any form of non-consented bulk messaging;
- use it for unlawful or deceptive activities, or activities that infringe third-party rights;
- load as business knowledge any information it is not entitled to use;
- attempt to access other businesses’ data, circumvent its plan limits or interfere with the operation of the service.
Breach of this section may lead to suspension or termination of the account.
9. Termination and account deletion
The account holder can delete their account at any time from the app itself. There is no need to request it by email or wait for anyone’s approval.
Deletion is transactional: it either completes in full or nothing is applied. If the holder is the sole owner of a business, the entire business and everything associated with it is deleted, including the raw messages WhatsApp sent about its customers and the connected channel’s credentials, which are erased from the encrypted store in that same operation.
Not everything disappears. What survives deletion, and why, is set out in the Privacy Notice and on the data deletion page.
10. Limitation of liability
Avenza is not liable for decisions taken by the business or its customers on the basis of the assistant’s replies, nor for the content the business loads as knowledge, nor for interruptions caused by the providers mentioned in section 7.
Nothing in these terms excludes liability that cannot be excluded under applicable law.
11. Changes to these terms
These terms may change. The version in force is always the one published on this page, with its effective date at the top, and this is where changes are checked: the app’s phone notifications are only used to flag customers waiting for a reply, not to announce changes to these terms.
12. Governing law
These terms are governed by the laws of the United Mexican States. For any dispute, the parties submit to the competent courts of Guanajuato, Mexico.
